Terms and conditions

Express Mag operates the Express Mag Web site (hereinafter referred to as the “Site”). Use of the Site is governed by the terms and conditions outlined below, which constitute a contract between you and Express Mag. Express Mag may amend these terms and conditions at any time.

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE USING THE SITE.

By accessing the Site, you confirm having read and understood these conditions. If you do not wish to be bound by these terms and conditions, you cannot use the Site to order products from Express Mag. Access to or use of the Site constitutes acceptance of its terms and conditions.

1.1 Applicable laws

Any claim regarding the Site and its contents, or ensuing as a consequence of the use of the Site, is governed by the laws of the Province of Quebec. In the event that any provision of these terms and conditions is declared illegal, unenforceable or void by a court decision, the other provisions shall remain valid and shall continue to apply. 

1.2 Restrictions related to Site use

The Site or any part of its content may not be copied, reproduced, communicated, published, made available or otherwise redistributed without the prior written authorization of Express Mag, other than as necessary in the usual course of the operation of the site by an authorized user. Any other use of this Site and its content is expressly prohibited and may be in violation of copyright law, criminal law, legislation relating to database protection, privacy and communications regulations and statutes.

1.3 Information transmitted by users

All items, information and opinions transmitted to Express Mag will become the complete and exclusive property of Express Mag. Express Mag reserves the right to use, reproduce or publish them. Furthermore, you are not permitted to transmit any items to Express Mag that may be illegal, slanderous, obscene or contrary to any applicable law. By transmitting any content to Express Mag, you hereby testify that you own any and all relevant rights to such content, including but not limited to copyrights. Express Mag reserves the right, at its sole discretion, to refrain from publishing or to retract any item you may have transmitted to it.

1.4 Liability limitations

Any risks arising from use of the Site, including but not limited to all information contained on it, are assumed entirely by the user. Neither Express Mag nor its affiliates, managers, employees, representatives or agents may be held responsible for any damages arising directly or indirectly from use of the Site, including but not limited to loss of data from the use of Site elements or the inability to use these elements (even if the user has advised Express Mag of the possibility of such damages).

The conditions, information and products contained on the Site, or which are topics of discussion on the Site, may be modified or updated without notice. The user accepts responsibility for informing himself or herself of Site updates. Furthermore, the user recognizes that Express Mag may, at any time and without notice, interrupt, in whole or in part, the Site’s operation. If the user does not agree with any of these update conditions, he or she must immediately cease using the Site.

While Express Mag makes every effort to ensure the Site contains no errors, it accepts no responsibility for any irregularities that may occur. Further, it does not guarantee the absence of viruses or other harmful content on the Site. It is the user’s responsibility to verify the accuracy and completeness of the information appearing on the Web site before relying on it.

Express Mag neither guarantees nor asserts that the Site will operate continuously, rapidly, safely or without error, that the results derived from use of the Site will be correct and reliable, or that any glitch or bug on the Site will be corrected, should such need arise. 

1.5 Use of personal information

Exclusive offers from Express Mag may be communicated to you by mail, telephone or email. Similarly, you may receive commercial offers from companies we have carefully identified and selected. 

However, at any time and at your request, we will undertake to remove your name from all internal lists and all lists rented to third parties. If you do not wish to be included on these lists, you must inform us in writing. 

You may also contact the Canadian Marketing Association. At your request, this organization will remove your name from the lists of all its members. You may write to them at 1 Concord Gate, Suite 607, Don Mills, Ontario, M3C 3N6, or visit their Web site. 

1.6 In case of fortuitous event

Express Mag is not responsible for any failure to fulfil, in whole or in part, any of its obligations to you, nor for any harm or losses you may suffer from a failure to fulfil any of the stated obligations, following a fortuitous event or any circumstance beyond its control.
